California Air Resources Board Will Workshop Omnibus Regulation Amendments
The California Air Resources Board (CARB) announced that it will hold a public workshop to discuss amendments to its Heavy-Duty (HD) Engine and Vehicle Omnibus (Omnibus) Regulation. The amendments have been proposed following extensive discussion between CARB and the Engine Manufacturers Association (EMA) during 2023, which culminated in CARB agreeing to revise its heavy-duty vehicle emission standards to align more closely with U.S. Environmental Protection Agency standards.
California Agencies Proceed With Revisions to Vapor Intrusion Guidance
California agencies issued a public notice that they will hold a workgroup to answer questions and engage with stakeholders on the agencies’ latest vapor intrusion guidance. The workgroup comes following years of confusion among stakeholders regarding the agencies’ application of draft guidance for addressing vapor intrusion, including during site cleanup and redevelopment.
California Air Resources Board Issues Clean Truck Check Implementation Guidance
On August 23, 2023, the California Air Resources Board (CARB) published additional guidance for the implementation of Clean Truck Check requirements under its Heavy Duty Inspection/Maintenance regulation. The requirements build on implementation guidance issued in June and set deadlines to achieve compliance with certain requirements beginning by December 31, 2023. Fleet owners and operators, and those contracting or brokering loads with heavy-duty trucks, should take note of CARB’s implementation timeline and prepare to comply with reporting and fee payment requirements beginning in the fourth quarter of 2023.
California Agency Proposes to List Microplastics and PPD derivatives to Candidate Chemical List
The California Department of Toxic Substances Control (DTSC) has proposed adding microplastics and PPD derivatives to its Candidate Chemicals List. This listing positions microplastics, and products containing them, for regulation and potential restrictions under the agency’s Safer Consumer Products Program. Companies with products containing microplastics and PPD derivatives should engage with DTSC in coming regulatory proceedings.

California Agency Releases Roadmap for Phaseout of High-Risk Pesticides
The California Department of Pesticides Regulation (DPR) recently released a “roadmap” for the state to fulfill two key goals by 2050: transition to sustainable pesticide management (SPM) and elimination of the use of “high-risk” pesticides. While the roadmap is aspirational and does not provide specific rules at this time, the roadmap goals were developed by a multiagency workgroup in coordination with various stakeholders. It is expected that proposed rules will be forthcoming from DPR and other state agencies as these agencies move toward achieving the roadmap goals.
California Senator Reignites Corporate Greenhouse Gas Emissions Disclosure Bill
A new bill introduced in the California legislature tees up corporate disclosure legislation that narrowly failed to pass the State Assembly during last year’s term. The bill would impose broad greenhouse gas (GHG) reporting requirements on large businesses doing business in California and could effectively set a national standard for these businesses to report GHG emissions.
California Air Resources Board Set to Finalize Ambitious Climate Plan
On November 16, 2022, the California Air Resources Board (CARB) released an updated version of its 2022 Scoping Plan for Achieving Carbon Neutrality. The plan sets ambitious goals for achieving carbon neutrality in California by 2045. Despite the plan’s being only a guiding document, it will likely lead to other agency actions that set stringent requirements related to reducing greenhouse gas emissions.
California State Water Board Announces Scoping Phase for New Vapor Intrusion Cleanup Requirement
On March 25, 2022, the California State Water Resources Control Board (State Water Board) issued a notice of public scoping meeting for a proposed amendment to its rules governing site cleanup. This amendment would establish “requirements for the investigation and assessment of vapor intrusion at cleanup sites statewide.”
