EPA Seeks Additional PFAS Data

On March 17, 2021, the U.S. Environmental Protection Agency (EPA or the Agency) issued a notice of proposed rulemaking (ANPRM) seeking information related to per- and polyfluoroalkyl substances (PFAS) to support a potential Clean Water Act rulemaking. With respect to PFAS from manufacturers and formulators, EPA requests public comment on the Agency’s current information and data and solicits additional information and data from stakeholders. This action is consistent with the Agency’s strategy in the January 11, 2021, effluent limitations guidelines (ELG) Plan 14, which identified publication of an ANPRM to solicit data and information regarding PFAS manufacturing and the presence and treatment of PFAS in industrial discharges.

In the ANPRM, EPA summarizes the Agency’s Multi-Industry Study and poses more than two dozen questions related to the identification of facilities, manufacturing processes, PFAS compounds, wastewater streams, wastewater treatment and management practices, and importation of PFAS.

The comment deadline is May 17, 2021.
